Daittons Partner Program Terms

Effective Date: [Insert Date]
Last Updated: [Insert Date]

These Partner Program Terms (“Partner Terms”) apply to all persons participating in any Daittons partner, recruiter, ambassador, referral or growth program, including without limitation the following roles where offered by Daittons:

  • Host Recruiters
  • City Ambassadors
  • Campus Recruiters
  • Corporate & Relocation Referral Partners
  • any other partner, recruiter, referral, promoter or city-growth role introduced by Daittons from time to time

These Partner Terms form part of the contractual framework between Daittons (Pty) Ltd (“Daittons”, “we”, “us” or “our”) and each partner participant (“Partner”, “you” or “your”).

By applying for, accepting, performing, promoting, referring under or remaining in any Daittons partner role, you agree to be bound by these Partner Terms, the Daittons Terms of Service, the Daittons Privacy Policy and any applicable partner schedule, commission schedule, operating guideline or written instruction issued by Daittons.

1. Purpose of the Partner Program

Daittons may appoint or approve Partners to assist with one or more of the following:

  • recruiting suitable Hosts for Daittons Destination Support;
  • referring student, business, relocation or general destination support opportunities;
  • building awareness for Daittons in a city, suburb, campus, travel corridor or market segment;
  • introducing Daittons to accommodation networks, student communities, business networks, relocation channels or corporate contacts;
  • supporting launch growth, local traction, approved promotional activity or other legitimate business development initiatives approved by Daittons.

2. Partner Roles

The specific role, title, city scope, referral focus, responsibilities or incentive structure applicable to a Partner may differ depending on the role granted by Daittons.

Examples may include:

Host Recruiter

A Partner focused primarily on identifying and referring suitable individuals to apply as Verified Destination Hosts.

City Ambassador

A Partner focused on helping Daittons grow in a particular city, suburb cluster, district or destination area, which may include awareness-building, host recruitment and approved local growth activity.

Campus Recruiter

A Partner focused on student and parent demand, student accommodation support channels, campus-based referrals and student-focused host recruitment.

Corporate & Relocation Referral Partner

A Partner focused on business, executive, conference, professional and relocation-related demand or contacts.

Daittons may create, remove, rename, merge or amend partner roles at any time.

3. Independent Relationship and No Employment

3.1 Independent status

Unless Daittons expressly agrees otherwise in a written contract signed by an authorised representative of Daittons, each Partner acts as an independent referrer, promoter or contractor and not as an employee, worker, labour broker employee, franchisee, legal representative, general agent or partner of Daittons.

3.2 No authority to bind Daittons

Partners may not, unless expressly authorised in writing by Daittons:

  • sign contracts on behalf of Daittons;
  • represent that Daittons has approved a person, Host, service or refund where Daittons has not done so;
  • promise guaranteed earnings, guaranteed host approval, guaranteed bookings or guaranteed city rights;
  • hold themselves out as directors, employees, attorneys, official spokespersons or legal representatives of Daittons;
  • make legal threats, settlement promises, contractual commitments or policy exceptions in the name of Daittons;
  • collect money on behalf of Daittons unless Daittons has expressly authorised that collection in writing.

4. Appointment and Approval

Participation in the Partner Program is subject to Daittons approval. Daittons may request information, conduct screening, verify identity, assess networks or market access, interview applicants, request references, or impose training or onboarding requirements before approving a Partner.

Daittons may reject, suspend, remove, downgrade, pause or terminate any Partner role in its discretion.

5. Partner Responsibilities

A Partner agrees to:

  • act honestly, professionally and lawfully;
  • present Daittons accurately and not make misleading statements about the business, the services, the host opportunity, earnings, verification, legal protection or the role of Daittons;
  • follow Daittons marketing, onboarding, compliance and referral instructions;
  • protect the Daittons brand and reputation;
  • respect confidentiality and privacy obligations;
  • provide truthful information about leads, referrals, hosts, cities and opportunities;
  • avoid spam, harassment, coercive recruitment, deceptive advertising or false urgency;
  • promptly disclose material conflicts, complaints, misconduct concerns or fraud that comes to the Partner’s attention in connection with Daittons activity.

6. What Partners May and May Not Say

Partners must not overstate Daittons’ role or make promises Daittons has not approved.

Without limitation, a Partner may not state or imply that:

  • Daittons guarantees a Host’s safety, honesty or future conduct;
  • Daittons guarantees that every approved Host will earn money;
  • Daittons guarantees city exclusivity unless Daittons has expressly granted it in writing;
  • Daittons guarantees a specific income level to any Partner, Host or User;
  • a referral is approved before Daittons confirms approval;
  • the Partner is an employee, legal representative or official spokesperson of Daittons unless authorised in writing.

7. Referrals and Lead Submission

Partners may refer prospective Hosts, Users, students, corporate opportunities, relocation opportunities or other approved leads to Daittons in the manner prescribed by Daittons from time to time.

Daittons may require that referrals be submitted through designated forms, tracking links, WhatsApp channels, email addresses, spreadsheets, onboarding workflows or CRM processes.

A referral will only be recognised if Daittons can reasonably attribute it to the Partner in accordance with Daittons records and applicable referral rules.

8. Commission and Incentive Principles

Daittons may pay commissions, referral incentives, bonuses, stipends, overrides or other approved earnings to Partners in accordance with a separate commission schedule, campaign terms, written offer or approved incentive structure.

Unless Daittons expressly states otherwise in writing:

  • no commission is earned merely because a lead was mentioned informally;
  • no commission is due until the qualifying event defined by Daittons has occurred;
  • Daittons may require payment by the referred person, successful onboarding, profile approval, completion of verification, survival beyond a cooling-off period, or another measurable event before a commission becomes payable;
  • Daittons may reject, reduce, reverse, withhold or claw back commissions connected to fraud, duplicate referrals, non-genuine leads, chargebacks, cancellations, refunded transactions, policy breaches or misrepresentation.

9. Typical Qualifying Events

Depending on the role and campaign, a qualifying event may include one or more of the following:

  • a referred Host completes onboarding, is approved by Daittons and pays the applicable verification fee;
  • a referred Host remains active for a specified minimum period;
  • a referred client pays Daittons for an approved service, coordination fee or package;
  • a referred corporate, relocation, student or campus opportunity converts into a qualifying paid transaction;
  • a city-growth milestone, campaign milestone or approved target is achieved.

Daittons reserves the right to define the qualifying event for each role or campaign.

10. Duplicate Referrals and Attribution

If multiple Partners claim the same lead, Host, client, campus contact, corporate contact or opportunity, Daittons will determine attribution in its discretion based on available evidence, timing, quality of submission, pre-existing relationship data, CRM records, written introductions, communication logs or other relevant information.

Daittons’ attribution decision will be final unless Daittons chooses to revisit it.

11. Payment Timing and Method

If a commission or incentive is approved, Daittons may pay it according to the payment cycle, threshold, documentation requirements and payment method determined by Daittons from time to time.

Daittons may require:

  • valid banking details;
  • proof of identity;
  • invoices where legally or operationally required;
  • tax information where applicable;
  • compliance with anti-fraud checks before release of payment.

Daittons may withhold payment pending investigation of fraud, disputes, reversals, policy breaches or legal concerns.

12. City Ambassadors: Additional Limitations

If you serve as a City Ambassador, your role is limited to the scope expressly granted by Daittons. Unless Daittons expressly authorises otherwise in writing, a City Ambassador may not:

  • appoint sub-agents or sub-ambassadors on behalf of Daittons;
  • sign local vendor agreements on behalf of Daittons;
  • promise legal representation, litigation support or court representation on behalf of Daittons;
  • represent that they own, control or exclusively operate a city on behalf of Daittons;
  • collect host fees, deposits or client payments in the name of Daittons without written authority.

A City Ambassador is a growth and referral role, not automatically a legal or corporate representative role.

13. Campus Recruiters: Additional Expectations

Campus Recruiters must take particular care when dealing with students, parents, guardians, accommodation providers and campus communities. They must not:

  • exploit fear, urgency or parental anxiety;
  • make false safety claims;
  • imply that Daittons is a university, residence, bursary body or official campus office unless this is true and authorised;
  • misuse student personal data or WhatsApp group access.

14. Corporate & Relocation Referral Partners: Additional Expectations

Corporate & Relocation Referral Partners must act professionally and must not:

  • imply that Daittons is a relocation law firm, immigration advisor, travel agency, security provider or corporate employer unless expressly true;
  • promise corporate service levels or contractual terms that Daittons has not approved;
  • use confidential business information improperly.

15. Marketing and Brand Rules

Partners may market Daittons only in a lawful, professional and brand-safe manner.

Partners must not:

  • use spam, bulk unsolicited messaging or unlawful contact practices;
  • use fake testimonials, false scarcity, fabricated earnings screenshots or deceptive before-and-after claims;
  • use Daittons branding in a way that suggests ownership, employment, legal authority or exclusivity without permission;
  • create unofficial websites, pages or forms pretending to be official Daittons channels without written approval.

Daittons may issue additional brand guidelines from time to time.

16. Confidentiality and Data Protection

Partners may receive or submit personal information, including names, phone numbers, email addresses, student details, travel needs, business contacts or host application details.

Partners must:

  • use personal information only for legitimate Daittons-related purposes;
  • protect it from misuse, unauthorised disclosure or careless handling;
  • comply with Daittons instructions and applicable law, including POPIA where applicable;
  • not sell, reuse or exploit Daittons lead data or personal information for unrelated purposes without lawful authority.

17. No Guarantee of Earnings or Exclusivity

Participation in the Partner Program does not guarantee:

  • any minimum income or commission;
  • approval of every lead or Host you refer;
  • exclusivity in a city, suburb, campus or market segment;
  • continued appointment as a Partner;
  • continued operation of any particular campaign or role;
  • automatic renewal of incentives or commission rates.

Daittons may change partner structures, campaigns, incentives, city priorities or strategic focus at any time.

18. Suspension, Removal and Clawback

Daittons may suspend, remove, restrict or terminate a Partner, and may withhold or claw back payments, where Daittons reasonably believes that:

  • the Partner breached these Partner Terms or another Daittons policy;
  • the Partner submitted fraudulent, duplicate, misleading, non-genuine or unauthorised referrals;
  • the Partner misrepresented Daittons, earnings, host approval, city rights or service quality;
  • the Partner engaged in harassment, spam, abuse, unlawful conduct or reputationally harmful conduct;
  • a referred transaction was reversed, refunded, cancelled, fraudulent or invalid under Daittons rules;
  • continued participation creates legal, operational, fraud or reputational risk.

19. Intellectual Property and Daittons Materials

All Daittons branding, marketing materials, referral tools, page copy, onboarding systems, logos, templates, forms, campaign structures and operating materials remain the property of Daittons or its licensors.

Partners may use approved Daittons materials only for authorised Daittons-related promotion and only in accordance with Daittons instructions.

20. Indemnity by Partners

Each Partner agrees to indemnify and hold harmless Daittons, its directors, officers, employees, shareholders, contractors and affiliates against claims, losses, liabilities, damages, costs and expenses arising out of or related to:

  • the Partner’s conduct, statements, promotions or omissions;
  • any misleading promise or unauthorised representation made by the Partner;
  • the Partner’s breach of these Partner Terms or applicable law;
  • misuse of personal information, brand assets or confidential information by the Partner;
  • disputes between the Partner and a Host, client, student, campus contact, corporate contact or third party.

21. Limitation of Liability

To the fullest extent permitted by law, Daittons shall not be liable to any Partner for indirect, incidental, special or consequential losses, loss of commission opportunity, loss of anticipated earnings, reputational harm, lost referrals, business interruption or losses arising from Daittons’ approval decisions, campaign changes, suspension decisions, attribution decisions or commercial strategy changes made in good faith.

Nothing in these Partner Terms excludes rights that cannot lawfully be excluded under applicable law.

22. Changes to the Partner Program

Daittons may amend these Partner Terms, revise role structures, change city allocations, modify commissions, alter qualifying events, pause campaigns, discontinue roles or introduce additional requirements at any time, subject to applicable law and any written agreement that expressly limits Daittons’ right to do so.

Continued participation in the Partner Program after the effective date of updated terms constitutes acceptance of the updated terms.

23. Governing Law

These Partner Terms are governed by the laws of the Republic of South Africa and are subject to the jurisdiction of the competent courts of South Africa, subject to any mandatory rights under applicable law.

24. Contact

Questions about the Daittons Partner Program or these Partner Terms should be directed to Daittons through the official contact details published on the Daittons Platform or through an official Daittons onboarding or partner support channel.
